These Terms of Service ("Terms") govern your access to and use of GPT Image 1.5 (the "Service") available at gptimage1-5.pro. By using the Service, you agree to these Terms.

1) The Service

The Service provides AI-powered tools, which may include:

Text-to-image generation
Image-to-image editing (including in-painting)
Image-to-video generation
Developer API access

Some features may require an account, credits, or a paid plan (e.g., "Pro").

2) Eligibility and accounts

You must provide accurate information when creating an account.
You’re responsible for activity under your account and for keeping credentials secure.

3) Trial limits, credits, and plan access

We may offer a free trial or limited free usage. Trial availability, limits, and feature access may vary and can change over time.

Credits may be required for certain actions (for example, higher-resolution outputs, bulk generation, or video generation).
If your trial limit is reached or you don’t have enough credits, the Service may restrict additional generation until you log in, purchase credits, or upgrade.

4) Your content and our license to operate

Your content

You may submit prompts, text, images, and other materials ("Input") and receive generated results ("Output"). Input and Output together are "Content".

As between you and us:

You retain any rights you have in your Input.
Subject to these Terms, you may use Output as permitted by your plan and applicable law.

License you grant us

You grant us a worldwide, non-exclusive license to host, store, process, reproduce, and transmit your Content only to the extent necessary to provide, maintain, and secure the Service (including generating Output, preventing abuse, and troubleshooting).

5) Commercial use and third-party rights

The Service may describe commercial-use features (for example, “commercial rights” on a Pro plan). You are responsible for ensuring your use of Output complies with:

applicable law,
these Terms,
and any third-party rights (e.g., trademarks, publicity/privacy rights, copyrighted works in Input, etc.).

We don’t provide legal advice, and we can’t guarantee that any particular Output is free of third-party claims.

6) Acceptable use

You agree not to:

violate any law or regulation;
infringe or misappropriate intellectual property or privacy rights;
attempt to bypass security controls, trial limits, rate limits, or quotas;
reverse engineer, scrape, or interfere with the Service;
use the Service to distribute malware or to harm others;
use the Service in a manner that is abusive, fraudulent, or intended to disrupt the platform.

We may suspend or terminate access if we believe you’ve violated these rules.

7) API terms (if applicable)

If you use API features:

You must keep API keys confidential and rotate them if exposed.
You must not resell or sublicense API access unless we expressly agree.
We may enforce rate limits and usage caps and may change them over time.

8) Payments

If you purchase a plan or credits:

Prices and available plans are shown during checkout.
Payments are processed by third-party providers (for example, Stripe or Creem).
You authorize us and our payment providers to charge your selected payment method.

Refunds (if any) are governed by our Refund Policy and applicable law.

9) Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service (including deleting or limiting access to Content where permitted) if:

you violate these Terms,
we need to prevent fraud or abuse,
or we are required to do so by law.

10) Disclaimers

The Service is provided "as is" and "as available".

We don’t guarantee that Output will be accurate, complete, or meet your needs.
We don’t guarantee uninterrupted or error-free operation.
AI-generated results may be unexpected, contain errors, or fail to follow instructions.

11) Limitation of liability

To the fullest extent permitted by law, the operator of gptimage1-5.pro will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or revenues arising from your use of the Service.

12) Indemnification

You agree to indemnify and hold harmless the operator of gptimage1-5.pro and its affiliates, officers, employees, and agents from claims arising out of (a) your use of the Service, (b) your Content, or (c) your violation of these Terms.

13) Governing law

These Terms are governed by the laws of the jurisdiction of our primary place of business, without regard to conflict-of-law provisions.

14) Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted. Your continued use of the Service after changes become effective constitutes acceptance.
